Terms of Use

These terms are an agreement between you and us about using the Pombu app and the pombu.com website. We keep them as simple as we can, but they apply in full.

1. Who we are and what these terms cover

Pombu is operated by 2-morrow s.r.o., Kravany 113, 059 18 Kravany, Slovakia, company ID (IČO) 36 839 523, e-mail support@pombu.tv (“we” or “Pombu”).

These terms are an end-user licence agreement (EULA) between you and us. By using Pombu you agree to them; when creating an account you accept them expressly. The Community Rules form part of them. How we process personal data is described in the Privacy Policy.

If you do not agree with these terms, do not use Pombu.

2. Who may use Pombu

• Anyone may watch, even without an account. Parents are responsible for what their children watch; fairy tales (Rozprávky) and films with an age rating that suits the child’s age (“For everyone” or “Age 7+”) are intended for children.
• You may create an account only if you are at least 16 years old. One account belongs to one person; do not lend, sell or transfer it.
• Use an e-mail address that belongs to you. You are responsible for everything that happens on your account. If you suspect misuse, write to us immediately.
• You may not create a new account if we previously terminated yours for violating these terms.

3. What Pombu offers

Pombu is a worldwide film library of independent creators: micro-dramas, short and feature films, fairy tales for children and music videos. Watching, liking, saving and following creators are free, with no ads and no subscription.

Creators have free access; they pay only for generating films in Pombu Studio, using credits. Pombu Studio generates characters, places, frames, voices and video from your instructions. You can also upload a film you shot yourself, and write stories and frames in your own ChatGPT account through the Pombu app in ChatGPT.

We may improve, change or discontinue features. If a change would significantly reduce something you paid for, we will tell you in advance.

4. Zero tolerance

Pombu has zero tolerance for objectionable content and for users who harass, intimidate or otherwise abuse others. We review every report within 24 hours at the latest. Within that time we remove objectionable or abusive content and block the account of the user who posted it: immediately and permanently for serious or repeated violations, otherwise temporarily. For a minor issue, such as an incorrect age rating, we may simply correct the rating or issue a warning (see section 12).

5. Prohibited content and conduct

You must not create, generate, upload, publish or share content on Pombu (including in a title, description, thumbnail, display name, @handle or avatar) that:

• sexualises children or depicts their abuse in any form, including drawn or generated; we always report such content to the police,
• is pornographic or contains sexual activity or nudity,
• shows gory or gratuitous violence, torture, or cruelty to people or animals,
• supports terrorism, violent extremism, criminal organisations or mass violence,
• spreads hatred or demeans people because of their origin, nationality, religion, sex, sexual orientation, disability or other characteristics,
• harasses, bullies or threatens, discloses other people’s personal data, or ridicules and humiliates someone,
• depicts a real person or imitates their likeness or voice without their consent (deepfake), or impersonates another person or organisation,
• promotes self-harm, suicide, eating disorders or dangerous challenges,
• promotes illegal drugs, weapons, gambling or other illegal goods and services,
• deceives in a way that can cause harm: fake news presented as fact, election manipulation, health misinformation, scams,
• infringes copyright, trademarks or other rights of others (for example someone else’s music, films or characters without a licence),
• contains spam, hidden advertising, misleading titles or thumbnails, links to harmful sites or malicious code,
• is otherwise unlawful under the law of the Slovak Republic, EU law or the law of the country where you use Pombu.

It is also prohibited to circumvent safety filters, misuse generation, scrape content automatically, interfere with the service, create fake accounts or artificially inflate views, likes or follows.

6. Real people, their likeness and voice

You may use (upload, generate or imitate) the likeness, face, body or voice of a real, identifiable person only if they have given you consent, and only in the way they agreed to. This also applies to public figures.

For children you need the consent of a parent or legal guardian, and a child must never be shown in an inappropriate, humiliating or dangerous situation.

A generated depiction of a real person without their consent (deepfake) is prohibited and leads to immediate blocking of the account. On our request you must prove the consent. Anyone who finds that they are shown on Pombu without consent can write to us and we will remove the content without undue delay.

7. Your warranties as a creator

When you upload, generate or publish anything on Pombu, you confirm that:

• you hold the rights to everything you use (text, images, photos, music, sounds, voices, video), or it is your own work,
• you have the consent of every real person whose likeness or voice you use (see section 6),
• your content does not infringe the rights of others or the law and complies with the Community Rules,
• you set the correct category and age rating for the film, and you labelled an uploaded film that contains realistically generated or altered parts.

If you breach these warranties and we or others suffer damage as a result (for example a third-party claim), you are liable for it to the extent provided by law.

8. Your content and the licence to Pombu

What you create is yours. You keep ownership and copyright in your content.

So that we can run Pombu, you grant us a non-exclusive, royalty-free, worldwide licence to the content you publish to:

• store, reproduce and technically adapt it (for example transcode, resize, create thumbnails and subtitles, add the synthetic content label and the Pombu logo),
• make it available and stream it in the app and on pombu.com,
• create exports with the Pombu logo and pombu.com,
• promote Pombu and your film, for example with a thumbnail, excerpt or poster in the app, on pombu.com, on Pombu’s social media profiles and in the App Store.

We may sublicense only to our technical providers and only for these purposes. For unpublished projects you grant us a licence only to the extent needed to store, process and generate them.

The licence lasts as long as your content is published on Pombu. When you take a film down or delete your account, we stop making it available; it disappears from caches and backups within the periods stated in the Privacy Policy. We stop distributing promotional posts already published and remove them at your request where reasonably possible.

We do not sell your films or material and do not use them to train models. With generation processors, where the service allows it, we choose settings under which they do not use them for training either. Other users may watch your published film on Pombu and share a link to it; we do not allow them any other use without your consent.

Export. You can export your film and share it outside Pombu too. The export carries the Pombu logo, pombu.com and, for generated content, the synthetic content label. Do not remove or cover these marks.

9. Generated content and its labelling

• Generation results are produced from your instructions. You are responsible for the instructions and for how you use the result.
• Generation may be neither accurate nor unique: someone else may receive a similar result, and not every result is protected by copyright. If we acquire any rights in a result, we leave them to you in full, to the extent the law permits.
• Instructions and results pass automated safety checks. We may stop a generation that would violate these terms.
• Under Article 50 of Regulation (EU) 2024/1689 (the AI Act), every generated film on Pombu is visibly labelled as synthetic content and, where technically feasible, also marked in a machine-readable way in the file. Do not remove, cover or circumvent the label, and do not present a generated film as a real recording of events.

10. Credits and purchases

• Credits are consumable in-app digital content you use to pay for generation in Pombu Studio. You buy them in packs through the App Store; you see the current price in the App Store before buying.
• The app shows how many credits a step will use before you start it. When you start it, the credits are reserved. If a generation fails, the reserved credits are returned to you automatically.
• Credits have no cash value and cannot be exchanged for money, transferred to another account or sold. They do not expire while we operate Pombu.
• Purchases and refunds are governed by Apple under its terms. You request a refund from Apple at reportaproblem.apple.com; we cannot refund payments. This does not affect your statutory consumer rights.
• If Apple refunds you for a credit purchase, we deduct those credits from your account. If you have already used them, your balance may become negative and further generation will be possible once you top it up.
• If a generation result is technically defective (for example a damaged or incomplete file), write to us at support@pombu.tv. We will assess the defect and return the credits or repeat the generation. This does not affect your statutory rights regarding defects in digital content and digital services.
• Unused credits are forfeited when you delete your account. They may also be forfeited if your account is terminated for a serious violation of these terms, unless the law provides otherwise.
• If we were to shut Pombu down, we will announce it at least 60 days in advance, stop selling credits, and you can use unused credits until then.

11. Linking ChatGPT

You can link your Pombu account with your own ChatGPT account through the Pombu app in ChatGPT (OAuth sign-in). ChatGPT is operated by OpenAI under its own terms and policies; we are not responsible for ChatGPT. We receive only what you send through the Pombu app in ChatGPT. Anything created in Pombu this way is subject to these terms. You can remove the link at any time.

12. Moderation, reporting and blocking

• You can report a film, profile or creator right in the app. You can block a creator and their content will no longer be shown to you. You can also report by e-mail to support@pombu.tv.
• Reports are reviewed by a person on our team within 24 hours at the latest. We also use automated filters to stop clearly prohibited generation; a person decides on removing published content and on blocking an account.
• Depending on severity we may remove content, restrict its visibility, change its category or age rating, temporarily restrict features, or suspend or terminate the account. Repeated violations lead to a permanent ban.
• We report content involving a suspected criminal offence threatening people’s life or safety, and child sexual abuse material, to law enforcement authorities.
• What we show you. The order of films in the app is determined mainly by recency, aggregated popularity (views, likes), language, category, age rating and the creators you follow. We do not use advertising profiles, and you can also browse films by category and by what is new.

13. Notices and statements of reasons under the Digital Services Act

Our single point of contact for users and authorities under Regulation (EU) 2022/2065 (the Digital Services Act) is support@pombu.tv. We communicate in English and Slovak.

Notice of illegal content

If you believe content on Pombu is illegal, send us a notice using Report in the app or by e-mail. Include:

• the exact link to the content (or the film title and creator name),
• an explanation of why you consider the content illegal,
• your name and e-mail (not required for notices of child sexual abuse material),
• a statement that you are submitting the notice in good faith and that the information is accurate and complete to the best of your knowledge.

We will confirm receipt, assess the notice diligently, objectively and without undue delay, and inform you of our decision, including whether automated means were used and what means of redress are available to you.

Statement of reasons

When we remove or restrict content, or suspend or terminate an account, we send the creator concerned a clear statement of reasons: what we did and to what extent, the facts we relied on, whether it followed a notice or our own initiative, whether automated means were used, which rule or law was breached, and the available means of redress. We omit the statement only where the law or an order of an authority prohibits it.

Redress

You can file a complaint against our decision, including a decision to keep content you reported, within 6 months at support@pombu.tv. The complaint is reviewed by a person, not an automated system, without undue delay; if it is justified, we reverse or change the decision. We will tell you the outcome with reasons. You can also turn to a certified out-of-court dispute settlement body under Article 21 of the Digital Services Act or to a court.

Misuse

If someone frequently publishes manifestly illegal content, we will suspend their account for a reasonable period after a prior warning. If someone frequently submits manifestly unfounded notices or complaints, we may stop processing them for a reasonable period after a warning. Notices from trusted flaggers are handled with priority.

14. Termination

• You can stop using Pombu at any time and delete your account right in the app: Library → Profile and settings → Delete account. This deletes the account and your personal data, and we remove your published films from Pombu.
• We may suspend or terminate your account if you violate these terms or the Community Rules, if the law requires it, or if you would cause harm to Pombu or others. In case of a serious violation (for example child abuse content, deepfakes, threats) immediately and without notice. We will tell you the reason under section 13.
• Provisions which by their nature should survive the end of the agreement (for example liability and governing law) continue to apply.

15. Availability of the service

We work to keep Pombu reliable, but we cannot guarantee that it will always be available and error-free. Maintenance, outages or changes at our providers may occur. Test versions (TestFlight) may contain bugs and features that will still change.

16. Liability

• Users who publish content are responsible for it. We host it and act on notices under section 13.
• We are liable for damage we cause by breaching our obligations as provided by law. If you use Pombu as a business, we are not liable for lost profit or indirect damage, except for damage caused intentionally or through gross negligence.
• Our liability is not limited for intent, gross negligence, injury to life or health, or where the law prohibits such limitation. Your statutory consumer rights, in particular your rights regarding defects in digital content and digital services, remain unaffected.

17. Apple and the App Store

These provisions apply if you use Pombu downloaded from the App Store:

• Acknowledgement. This agreement is concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for Pombu and its content.
• Scope of licence. We grant you a limited, non-exclusive, non-transferable licence to use Pombu on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the App Store Terms of Service; Pombu may also be used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
• Maintenance and support. We are solely responsible for providing maintenance and support for Pombu. Apple has no obligation whatsoever to furnish any maintenance or support services for Pombu.
• Warranty. If Pombu fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of Pombu (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Pombu; any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
• Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Pombu or your possession and use of it, including (i) product liability claims, (ii) any claim that Pombu fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy or similar legislation.
• Intellectual property. If a third party claims that Pombu or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with applicable third-party terms when using Pombu (for example your agreement with your mobile carrier or internet provider).
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

18. Governing law and disputes

These terms are governed by the law of the Slovak Republic. If you are a consumer living in another country, you keep the protection given to you by the mandatory provisions of the law of your country, and you may also bring proceedings before the courts where you live.

If a dispute arises, please write to us first; we try to resolve it by agreement. If you are a consumer and we rejected your request for redress or did not reply to it within 30 days, you can file a request for alternative dispute resolution with the Slovak Trade Inspection (soi.sk) or another authorised body listed by the Slovak Ministry of Economy.

If any provision of these terms is invalid, the remaining provisions remain in force.

19. Changes to these terms

We may change these terms, for example when we add a feature or the law changes. We will notify you of a material change in the app or by e-mail at least 30 days in advance, except for changes required sooner by law or for security. If you do not agree with a change, you can delete your account; if you continue to use Pombu, the new terms apply.
